Accepting these terms

These Terms of Use (the “Terms”) apply to the GoGenius website at gogeniusapp.com. If you use the website, these Terms apply to that use to the extent the law allows. If you don’t agree with them, please don’t use the website.

Showing you these Terms doesn’t take away any rights you have. Where the law requires your active agreement, we’ll ask for it separately.

Who we are

The website is run by Waterside Labs LLC, the company that makes GoGenius. In these Terms, “we”, “us” and “our” mean Waterside Labs LLC.

Using the website

You may browse the website, share links to it, and save or print reasonable parts of it for personal or work reference, keeping any copyright notices in place. This doesn’t give you ownership of anything or let you resell or republish our content commercially.

Please don’t use the website to:

• break the law or anyone else’s rights;
• pretend to be someone else, or send threats, harassment or spam;
• introduce harmful code, or try to access systems or information you’re not allowed to; or
• interfere with the website’s security or availability, including with automated requests that seriously disrupt it.

Normal search engine indexing, assistive technology and anything else the law protects are fine. If you find a security problem, please email us without accessing other people’s data or disrupting the website. Nothing here stops you from quoting or commenting on our content as the law allows, writing honest reviews, reporting to regulators or taking part in legal proceedings.

Our name, logo and content

The GoGenius name and logo, and the website’s artwork, text, design and code, belong to Waterside Labs LLC and are protected by intellectual property laws. Fonts and other third-party material belong to their owners. Except as these Terms allow, the law permits or we agree in writing, you may not copy, change, distribute or commercially use any of it.

You may mention GoGenius truthfully and link to us, but please don’t use our name or logo to suggest we sponsor or endorse you. If you think something on the website infringes your rights, email us with the page address, a description of the problem and a way to contact you.

The GoGenius app

The GoGenius app isn’t available yet. It’s still being built, so details may change. Nothing on the website promises a release date, particular features, prices, availability or results, or is an offer to sell anything. These Terms don’t cover the app. The app’s own terms and privacy policy will be published before it launches.

Not professional advice or an assessment

GoGenius is a practice app for goals you choose, in areas like learning, focus, communication and confidence. It is not a medical, psychological or educational assessment. Nothing on this website is medical, psychological, legal, financial or other professional advice, or a substitute for it.

If you’re worried about your health or safety, speak to a doctor or another qualified professional. In an emergency, contact your local emergency services.

Emails and feedback

Please email us only information you have the right to share, and don’t send passwords, financial details, medical records or confidential business material. An email doesn’t, on its own, create a confidentiality agreement or a professional, customer or employment relationship.

You keep ownership of what you send. We use your message as reasonably needed to consider it and reply, as explained in our Privacy Policy. Sending feedback doesn’t give us ownership of your ideas or unlimited rights to use them; any broader use can be agreed separately.

Links to other sites

The website may link to other websites, including the Waterside Labs company website. Services run by others have their own terms and privacy practices. We don’t control them, and a link doesn’t mean we endorse them.

Disclaimers and limits on liability

We try to keep the website accurate, but it may contain mistakes or go out of date. We may update, pause or remove parts of it, or limit access, when reasonably needed for maintenance, security, preventing misuse or legal reasons, and we don’t promise it will always be available.

To the extent the law allows, the website is provided “as is” and “as available”, without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, merchantability or non-infringement.

To the extent the law allows, Waterside Labs LLC is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, this website.

None of this limits liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, death or personal injury caused by negligence, or any liability or remedy that can’t lawfully be excluded or limited. Mandatory consumer protections and other rights that can’t be waived still apply. Where the law doesn’t allow a limit, that limit doesn’t apply.

Governing law and disputes

To the extent the law allows, these Terms are governed by the laws of the State of New York and applicable United States federal law, without applying conflict-of-laws rules that would replace them. This doesn’t take away mandatory protections you have under the law where you live or use the website.

You can contact us to sort out a concern, but you don’t have to before seeking legal relief, and doing so doesn’t extend any filing deadline. These Terms include no mandatory arbitration, class-action waiver, jury-trial waiver, required court location or limit on contacting a regulator. A dispute may be brought in a court with lawful jurisdiction.

Changes to these terms

We may update these Terms as the website changes, and we’ll change the effective date above when we do. Changes apply from that date onward and don’t take away rights you already have. Where the law requires extra notice or your agreement, we’ll give or ask for it.

General

If part of these Terms can’t be enforced, it will be limited or removed only as far as needed, and the rest still applies. Not enforcing a part straight away doesn’t stop us from enforcing it later. These Terms don’t override a separate signed agreement with us or give anyone else a right to enforce them, unless the law says otherwise.
